Lawful permanent residence is one of the most consequential steps in any immigration journey, and the path to a green card is rarely simple. At Dehra Miotke, LLC, our attorneys bring more than 50 years of combined immigration experience to green card cases across family-based, employment-based, and humanitarian pathways. We’ve helped thousands of individuals, families, and businesses in the Tampa area pursue permanent residence, including matters complicated by prior denials, removal proceedings, or previous attorney errors.

We represent clients before USCIS, the Department of Labor, and U.S. consular posts worldwide. For clients who prefer to communicate in Spanish, Hindi, Punjabi, or Urdu, our attorneys work directly in those languages without a translator.

Green Card Pathways We Handle

A green card grants lawful permanent resident status, allowing the holder to live and work in the United States permanently and, after meeting residency requirements, to pursue naturalization. Which pathway applies to you depends on your relationship to a U.S. citizen or permanent resident, your employment situation, or other circumstances in your case.

Family-Based Green Cards

Spouses, unmarried children under 21, and parents of U.S. citizens qualify as immediate relatives and face no annual visa cap. Other family members, including siblings and married children of citizens, fall under family preference categories subject to annual numerical limits and priority date backlogs. We handle marriage-based petitions, petitions for spouses and children of lawful permanent residents, and cases across the family preference categories.

Employment-Based Green Cards

Employment-based green cards are organized into preference categories from EB-1 through EB-5, based on job type, qualifications, and employer sponsorship. Many EB-2 and EB-3 cases require permanent labor certification (PERM) filed with the Department of Labor before an immigrant petition can move forward. We also handle investor-based cases, including EB-5. Whether you’re an employer sponsoring a worker or an individual navigating a self-petition, we can guide you through the process.

Humanitarian & Other Pathways

Certain humanitarian protections, including U Visa and VAWA relief, can create a pathway to permanent residence. We handle these cases and can assess how asylum or other immigration history may intersect with a green card application.

Why Tampa Clients Choose Dehra Miotke, LLC

Our practice is devoted entirely to immigration law, which keeps our attorneys current on USCIS procedures, Department of Labor requirements, and immigration court processes. That focus translates directly into more precise case preparation and fewer avoidable mistakes.

  • Direct attorney access: Clients speak with an attorney on case decisions and questions, not just support staff.
  • Meticulous preparation: We organize evidence carefully, double-check forms and timelines, and confirm documents are complete before filing.
  • Interview readiness: We prepare clients thoroughly for USCIS interviews, including practice sessions and a clear picture of what to expect on the day.
  • Persistence in difficult cases: We take on prior denials, removal proceedings, and cases others view as unlikely to succeed, and we keep advocating.
  • Recognized practice: Dehra Miotke, LLC is an AILA member and received the 10 Best Attorney recognition from the American Institute of Legal Counsel in 2019.

The Green Card Process in Tampa

How your case moves forward depends on where you are. Applicants already in the United States typically pursue adjustment of status by filing Form I-485 with USCIS. Applicants abroad complete the process through consular processing at a U.S. embassy or consulate. Most cases also require a separate immigrant petition filed first or concurrently: Form I-130 for family-based cases or Form I-140 for employment-based cases, depending on the category and visa availability.

Stages of the Application

Tampa-area applicants generally attend a biometrics appointment and, when required, an in-person interview at the USCIS Tampa Field Office in Hillsborough County. We prepare clients for every stage: eligibility review, petition filing, biometrics, and the interview itself. If USCIS issues a Request for Evidence (RFE) asking for additional documentation, responding thoroughly and on time is critical to keeping the case on track. We handle RFE responses with the same care as the original filing.

Processing Times & Staying Informed

Processing times vary by category and visa availability. Employment-based categories with backlogs can involve extended waits tied to the Visa Bulletin priority date system. We keep clients informed as deadlines approach and after submissions, and we respond quickly to questions throughout the process, including during longer waiting periods.

Difficult & Previously Denied Green Card Cases

A prior denial doesn’t necessarily end the path to permanent residence. The grounds for the denial, the category involved, and any changed circumstances all affect what options remain. Common reasons for denial include incomplete documentation, prior immigration violations, certain criminal history, and issues flagged during the medical examination. Depending on the situation, options may include a motion to reopen or reconsider, an appeal to the Board of Immigration Appeals, or, in some circumstances, federal court review.

Before recommending any path forward on a complex matter, we take time to identify what went wrong, whether that’s a documentation gap, a prior deportation order, or an error made by a previous attorney. We’re upfront when a case is difficult, and we lay out a realistic picture of the options so clients can make informed decisions. We also handle cases where removal proceedings are ongoing and permanent residence may remain a viable goal alongside or following defense.
