My family and I would not have been in the U.S. but for Attorney Amit Dehra and Attorney John C. Miotke. I still remember that I had a final order of removal “deportation” and I had lost hope. My family and I were asked to depart the U.S by the Immigration Judge. I still remember that it was a Friday evening when I called Attorney Amit Dehra and explained briefly about my situation and final order of removal. He asked me to come immediately to his office. My case is a classic case where, unknown to me, there was a final order of deportation against me for the last 10 years. I was unaware of this, despite the fact that I had signed a Notice to Appear (“NTA”) accepting the service of NTA. However, in reality I had not been delivered this Notice to Appear, even though I had accepted the service. In the interim, I had got married to a United States Citizen and a United States citizen son was born to us from this marriage. I approached many Immigration Attorneys who did not show any positive signs in my case. Finally, I approached Attorney Amit Dehra who explained me that a Motion to Reopen was required in my case. Also, under the circumstances, it will be an uphill task to convince the Immigration Judge that I had never received the Notice to Appear and did not know about the Court hearing date, despite me having signed the NTA. Attorney Amit Dehra explained me that a “polygraph” test is recommended to establish my credibility. I voluntarily took the polygraph test which reiterated our position that I did not receive the NTA and any Immigration hearing date. We filed the Motions and got the stunning result – my Motion to Reopen was granted by the Immigration Judge and now I can proceed with my adjustment. It was a huge relief. Both my employer and I were concerned and had little hope in getting an H-1 approval. I cannot thank Amit Dehra enough! I was told by many prominent Immigration Attorneys that I an ineligible to obtain a U.S. green card in the U.S. because I entered the country illegally. However, what all immigration attorneys, except Attorney Amit Dehra, failed to ask me was if, “I was the Beneficiary of any petition filed on or before April 30, 2001.” This was the specific question asked my Attorney Amit Dehra and I said “yes”. After carefully reviewing the documents, I was informed that I am eligible to adjust in the U.S., despite the fact that I entered illegally in the U.S. I was told that I am a beneficiary under section 245(i) of the Immigration and Nationality Act. We filed paperwork and I was interviewed by the Service. The interview went well and Attorney Amit Dehra informed the Service how I qualified under 245(i) of the Act and my green card case was approved. Today, I am a green card holder. I am a war veteran. I initially filed a pro-se fiancé visa for my then fiancé, who resided in China.
