My case is a classic employment based case. I am a pharmacist manager now. My initial labor certification was filed by another law firm, even though I wanted to go through Attorney Dehra. Labor Certification was certified but under EB-3 category. My Form I-140 was also approved under EB-3 professional category. Due to long waiting times (priority dates) for Indian born applicants under EB-3 category, the wait was extremely frustrating. Attorney Dehra advised me to file a second labor certification through my new employer under EB-2 (employment based second preference) category. We filed it under my new job title i.e., Pharmacy Manger and labor was certified without any audit. My Form I-140 was also approved under EB-2 category. What happened thereafter was magic: my previous I-485 was pending based on I-140 approved under EB-3. Attorney Dehra was able to get the same I-485 approved by assigning not only same old priority date which belonged to EB-3 case, but also using the existing I-485 and getting it approved. It is amazing how my immigration problem was resolved by Attorney Amit Dehra. My husband and I live in the jurisdiction of West Palm Beach USCIS office. I have been living in the U.S. without documents for more than 10 years. I came to this country as a young child with my parents, who have since left the U.S. Prior to consulting Attorney Dehra, many attorneys with whom I consulted gave me no hope and informed me that there is no way I can adjust in the U.S. This is because I came to this country illegally. I still think whether it is true or not. How did it happen? I was in removal proceedings when I contacted Attorney Dehra. My previous attorney suggested that I should request voluntary departure from the Orlando Immigration court and leave the U.S. on my own accord. This is when I consulted Attorney Dehra. He informed me that I am eligible to file “battered spouse” petition i.e., Form I-360 as I had been a victim. We submitted extensive documents to USCIS as proof of how I am a battered spouse (even though I am a male). In the interim, Attorney Dehra requested continuance from Immigration Judge. It was a marathon hearing which lasted approximately 4 hours before Immigration Judge. Immigration was trying to establish that I was involved in fraudulent marriage, which was not true. I was nervous throughout the hearing. I had retained Attorney Dehra in the year 2004. I was placed in removal proceeding back then. Attorney Dehra defended me but the Judge did not grant my case. We filed a timely appeal of my asylum claim. We had retained Dehra Miotke to represent us in a family based petition. My mother could not produce either a Not Found Birth Certificate or Birth Certificate due to unique circumstances of the facts. She was born in South Africa, but was an Indian citizen. Later, she moved to United Kingdom and became a British citizen. It was difficult to convince USCIS that under the circumstances none of the requested documents i.e., Not Found Birth Certificate or Birth Certificate were available or could be made available. Indian consulate in Houston would not issue a birth certificate because my mother was a British citizen and was not Indian citizen anymore. Eventually, Attorney Dehra was able to present the facts before USCIS and convinced them to use secondary evidence (which we had). I can explain the relief my wife and I received from the services of Attorney Amit Dehra. We had retained him to represent us before Immigration Court. We were unhappy with our previous Attorney who was totally unprofessional and filed paperwork before Court without even discussing with us. So much so – she submitted my handwritten declaration to the court. It appeared our case had no hope. When we retained Attorney Dehra, he requested court to continue the case so that he can prepare the case and submit more documentation. I was in a desperate situation. I worked with one of the top IT (Fortune 500) companies. My Form I-140 was already approved through this employer and my Form I-485 was pending. I had not renewed my H-1B, as I relied on pending I-485 and was expecting it to be approved soon. Unknown to me, there was a Request for Evidence (“RFE”) issued in my pending Form I-485 and this RFE was not forwarded to me. As a result my Form I-485 was denied. By this time, I was no longer working with my sponsoring employer. I was in severe stress. I contacted several immigration attorneys. I consulted Immigration Attorney Amit Dehra of Dehra Miotke. He informed us that I am eligible to file a brand new Form I-140 Immigrant Petition based on extraordinary ability under Employment Based First Preference category. My principal concern was that I had been out of status and how could I remain in status. Attorney Dehra explained me that even though I am out of status, but I could take advantage of section 245(k), which in summary states that employment based “green card beneficiary” could still be issued a green card to the applicant as long as he/she has been out of status for less than 180 days, provided certain other conditions are met. After filing Form I-140, and I-485, we received a boiler plate Notice of Intent to Deny. Attorney Dehra and his staff worked tirelessly. With their hard work, we were able to establish that my work has made a significant contribution within my field, that I command a significantly higher salary for my work based on my abilities, that I played a leading or critical role for organizations or establishments that have a distinguished reputation. My case is a classic case where the Service was unsatisfied if I benefit from section 245(i) of the Act. I had a previous Labor Certification, through which I became eligible to receive a green card despite the fact that I had been living in the U.S illegally for many years. My case involved few complexities. I was arrested by Immigration and Custom Enforcement (“ICE”) when I voluntarily appeared for NSEERS registration. I had retained Attorney Dehra prior to visiting ICE. I have a very interesting story to share! Once of my distant relative, who was a client of Attorney Dehra took me for a legal consultation. My main concern was how I could get my driver’s license renewed. After thoroughly discussing my case, I was surprised by the answer Attorney Dehra provided me. He said, “I can help you in getting a green card and you should have the same in about 6 (six) months” I was shocked. Apparently, there was I-130 petition for which the visa numbers were available but many previous attorneys I had consulted opined that I will have to leave the country to obtain a green card. Furthermore, due to 3 year-10 year bars applicable in the case, I will need waiver in the consulate. I was not comfortable with the previous legal opinions. Anyway, Attorney Dehra informed me that I am protected by section 245(i) of the Act and hence I need not leave the country to obtain my residency. I trusted him. I was granted asylum by the Immigration Judge. As a matter of fact, I was unhappy with my previous attorney who was working on my Labor Certification. I changed my immigration attorney. Before we met Mr. Amit Dehra, we had received poor legal advice which caused me and my wife a lot of heart-ache and trouble. The advice we received banned me from visiting my wife in the United States and required her to come to London, U.K. to see me in order to maintain our relationship. I do not know where to start from. I retained Attorney Amit Dehra to help me in obtaining a fiancé visa for my fiancé. My fiancé does posses dual nationality. Dehra Miotke filed the appropriate paperwork with USCIS and after the case was approved it was forwarded to the Consulate for visa interview in a timely fashion. Shockingly, at the time of visa interview, the Consulate denied the visa to my fiancé stating that she had been previously removed from the U.S. and hence require Form I-601 “extreme hardship” waiver. My fiancé and I were disappointed for two reasons: One, per the information of the Consulate, it takes many months and two, the approval is entirely discretionary. When we explained the results of interview to Attorney Dehra, he asked us to remain calm and let him deal with the situation. Dehra Miotke researched the issue and concluded that the Consulate had made a legal error. As per the law, citizens of certain countries who try to enter the U.S. on a “visa waiver” program cannot be removed. Attorney e-mailed to the Consulate with a legal memo and relayed his message about the inadvertent error made by the Consulate. They realized the mistake and immediately scheduled my fiancé for another interview with in a week. Yes, you guessed it right - she got the K-1 visa.

After her entry, we got married and Dehra Miotke represented us during the green card process. It went well and my wife is now a Lawful Permanent Resident. All thanks to Attorney Amit Dehra and his team. I have to say that without quality immigration representation, I am not sure how this could have worked so efficiently.

Attorney Amit Dehra did a tremendous job in my immigration case. My case had been pending for many years and many immigration attorneys had requested me to stay with the original employer until I get my green card.
